Terms of Service

These Terms of Service ("Terms") govern access to and use of the services provided by Create Flow, Inc. ("Create Flow," "we," "us," or "our"), including any software, APIs, applications, AI-powered services, documentation, and related offerings (collectively, the "Services"). These Terms apply to business and enterprise customers only. By accessing or using the Services, you represent that you are acting on behalf of a business entity and have authority to bind that entity to these Terms. Contact: contact@create-flow.ai

1. Services Overview

Create Flow provides AI-enabled workflow, automation, data processing, and content generation services. The Services may involve automated decision-making, large language models, and integrations with third-party platforms. The Services are provided for general productivity and automation purposes only and are not designed for regulated, mission-critical, or safety-critical use cases unless expressly agreed in writing.

2. Customer Responsibilities

2.1 Authorized Use

Customer shall use the Services solely for lawful business purposes and in accordance with these Terms. Customer is responsible for all activity conducted under its accounts, including actions by employees, contractors, and authorized users.

2.2 Data Responsibility

Customer bears sole responsibility for:

  • The legality, accuracy, and appropriateness of all data submitted to the Services
  • Ensuring it has all necessary rights, permissions, and consents to submit such data
  • Determining whether the Services are suitable for Customer's intended use

3. Customer Data

3.1 Definition

"Customer Data" means any data, content, prompts, text, files, emails, URLs, or other materials submitted to or processed by the Services.

3.2 License to Process

Customer grants Create Flow a non-exclusive, worldwide, royalty-free license to host, store, transmit, process, reproduce, and analyze Customer Data solely to provide, maintain, secure, and improve the Services.

3.3 No Sensitive or Confidential Data

Customer shall not submit confidential or proprietary information, personal data subject to heightened regulatory requirements, trade secrets, or regulated data (including but not limited to HIPAA, PCI, GLBA, or similar) unless expressly agreed to in a separate written agreement signed by Create Flow. Submission of such data is at Customer's sole risk.

4. Data Processing, Security, and SOC 2–Aligned Controls

4.1 Security Measures

Create Flow maintains commercially reasonable administrative, technical, and organizational safeguards designed to protect Customer Data against unauthorized access, disclosure, or loss. These safeguards are risk-based and aligned with generally recognized industry practices, including principles consistent with SOC 2, without guaranteeing absolute security.

4.2 No Security Guarantee

Customer acknowledges that no system is completely secure. Create Flow does not warrant or guarantee that Customer Data will be immune from unauthorized access, breaches, or misuse.

5. Third-Party Services and AI Models

(CRITICAL ENTERPRISE DISCLAIMER)

5.1 Use of Third Parties

The Services may integrate with, rely on, or transmit Customer Data to third-party services, infrastructure providers, APIs, and artificial intelligence models ("Third-Party Services"). These Third-Party Services are not controlled by Create Flow.

5.2 No Responsibility for Third-Party Data Handling

Create Flow expressly disclaims responsibility and liability for data retention, training, storage, or processing practices of Third-Party Services; security failures, data breaches, or misuse caused by Third-Party Services; and any outputs or decisions generated by third-party AI models. Customer is solely responsible for reviewing and accepting the risks of such Third-Party Services.

5.3 No Confidentiality Obligation for Customer Data

Customer Data may be stored, processed, logged, or retained by Create Flow and Third-Party Services as part of normal operation. Create Flow assumes no obligation to treat Customer Data as confidential unless expressly agreed in writing.

6. AI-Generated Outputs

AI-generated outputs are probabilistic, automated, and may be inaccurate, incomplete, or misleading. Customer is solely responsible for reviewing and validating all outputs; any decisions, actions, or reliance based on outputs; and compliance with laws and regulations applicable to Customer's use case. Create Flow makes no representations or warranties regarding AI output accuracy, completeness, or suitability.

7. Prohibited Use

Customer shall not:

  • Use the Services to violate laws or regulations
  • Reverse engineer or extract models or systems
  • Circumvent safeguards or access controls
  • Use the Services for high-risk or regulated purposes without written approval

8. Intellectual Property

Create Flow retains all rights, title, and interest in the Services, including all software, models, workflows, and documentation. No rights are granted except as expressly stated.

9. Suspension and Termination

Create Flow may suspend or terminate access to the Services immediately if Customer breaches these Terms; Customer poses a security, legal, or operational risk; or if required by law or third-party obligations.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." CREATE FLOW DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND DATA SECURITY.

11. Limitation of Liability

(ENTERPRISE-GRADE CAP)

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • CREATE FLOW SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES
  • CREATE FLOW SHALL NOT BE LIABLE FOR DATA LOSS, BREACHES, OR DISCLOSURE, INCLUDING THROUGH THIRD-PARTY SERVICES OR AI MODELS
  • CREATE FLOW'S TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY CUSTOMER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM

12. Indemnification

Customer shall indemnify and hold harmless Create Flow from claims arising out of Customer Data; Customer's use of the Services; or Customer's violation of law or third-party rights.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

14. Amendments

Create Flow may update these Terms from time to time. Continued use constitutes acceptance.
